General conditions of sale

These General Conditions of Sale govern the relations between the company Le Petit Artiste, SAS with capital of €100, 107 chemin des Mines 30120 Molières-Cavaillac, RCS de NIMES 979576527, and its CUSTOMERS, for any order placed from October 1, 2023 in catalogs

The Little Artist by all means.

Excluded from Le Petit Artiste customers: childminders, nurseries, schools, all care, accommodation and educational establishments for adults and minors.

By “products” we mean those presented in the catalogs of the company Le Petit Artiste existing in paper format, in electronic format and on the website lepetitartiste.fr.

This catalog is exclusively sold remotely via orders:

  • Online on the website: lepetitartiste.fr
  • By telephone on 04 67 22 42 97 according to the following times:
    • Monday: 9:00 a.m.–12:00 p.m., and 1:30 p.m.–5:30 p.m.
    • Tuesday: 9:00 a.m.–12:00 p.m., and 1:30 p.m.–5:30 p.m.
    • Wednesday: 9:00 a.m.–12:30 p.m., and 1:00 p.m.–4:30 p.m.
    • Thursday: 9:00 a.m.–12:00 p.m., and 1:30 p.m.–5:30 p.m.
    • Friday: 9:00 a.m. – 12:30 p.m., and 1:30 p.m. – 5:00 p.m.
    • Saturday: closed
    • Sunday: closed

These General Conditions of Sale apply to all sales made within the framework described above, with the exception of clauses relating to delivery conditions which only apply to sales delivered in France Metropolitan.

For international deliveries, in Corsica or in the DROM-COM, the special delivery conditions will be communicated on simple request by the Export Department reachable on 04 67 22 42 97 or by email at contact@lepetitartiste.com.

A - GENERAL PROVISIONS

A.1. The General Conditions of Sale govern the sales contracts entered into between the CUSTOMER and Le Petit Artiste within the scope defined in the preamble above.

A.2. Any order placed with Le Petit Artiste implies unreserved acceptance of these General Conditions of Sale, notwithstanding any clauses and stipulations to the contrary. No particular condition can prevail over these General Conditions of Sale, unless accepted in writing and signed by Le Petit Artiste. Any contrary Condition posed by the CUSTOMER, not expressly accepted by Le Petit Artiste, will therefore be unenforceable against him regardless of the moment when it is brought to his attention.

The fact that Le Petit Artiste does not avail itself at a given moment of any of these General Conditions of Sale cannot be interpreted as a waiver of the right to avail itself subsequently of any of the said conditions.</p >

A.3. Retention of title clause: In accordance with articles L 624 16 of the Commercial Code and 2367 et seq. of the Civil Code, these conditions include a reservation of title clause. Le Petit Artiste thus retains full ownership of the products sold until full collection of the price, including fees and taxes. The CUSTOMER bears, from their shipment, the risks relating to the products and undertakes to take all care in the care and conservation of the products and to take out all necessary insurance, up to sufficient capital.</p >

A.4. Modification of the General Conditions of Sale: Le Petit Artiste reserves the right to adapt or modify these General Conditions of Sale at any time. Any modification will be brought to the attention of the CLIENT and will be visible online on the site lepetitartiste.fr. The conditions in force on the day of the order will be applied to each order.

A.5. These General Conditions of Sale are governed by French law. In the event of a dispute relating to the interpretation or execution of the clauses of these General Conditions of Sale, the competent Court will be:

  • for professionals: the Commercial Court of Nîmes (30), regardless of the place of delivery, the method of payment accepted, and even in the event of a warranty claim or multiple defendants
  • for individuals: the Civil Court chosen by the most diligent Party.

B - THE PRICE

B.1 Price applicable when ordering:

The sales price of each product is understood to be that mentioned in the Le Petit Artiste catalog at the time of the order, excluding specific promotions and subject to typographical error(s) or modification(s). legal(ies). In the event of a different price between the paper catalog and the online catalog, the price mentioned in the online catalog (including any subsequent “erratum” type corrections) will be authentic and take precedence.

B.2. Elements making up the sale price:

The prices mentioned in the catalog are inclusive of ex-tax (excluding transport and packaging costs). Any tax, duty or other service to be paid in application of French laws and regulations or those of an importing country or a transit country are the responsibility of the CUSTOMER.

Unless specifically stated, no service is included in the sale price (assembly, repackaging, etc.), these services are the responsibility of the CUSTOMER.

B.3. Contribution to transport and packaging costs:

B.3.1. For deliveries in mainland France, a flat rate contribution of €5.95 will be charged.

B.3.2. For Corsica and the Islands, the products in our catalogs are subject to additional shipping costs, in particular €17 for Corsica; the CUSTOMER is requested to consult our Customer Service.

B.3.3. In the event of delayed delivery of an item, due to the fault of Le Petit Artiste, no contribution to shipping costs will be invoiced for this item, unless specifically mentioned. In the event of delayed delivery of an item, due to the CUSTOMER's fault, the usual shipping costs will be charged.

C - PAYMENT TERMS

C.1. Payment method:

Unless otherwise agreed, the customer must pay by credit card.

C.2. Payment due date:

Payment is made upon ordering.

C.3. Late payment:

The order can only be shipped after receipt of payment by the company.

D - TRANSPORT

D.1. Delivery terms and times:

The Le Petit Artiste product(s) ordered is (are) shipped within 3 working days from the date of receipt of validation of the order (and/or full payment) subject to reservation the availability of said Catalog product in stock, or its manufacturing time by the factory.

D.2. On simple request, the CUSTOMER can benefit from delivery in 24 or 36 hours, in exceptional cases of urgent needs, subject to availability, at higher rates.

D.3. Special cases during the summer periods and during the last week of the year:

D.3.2. Summer holidays: any order entered electronically and received from July 14 to August 15 is deliverable from week 36.

D.3.3. December holidays: any order entered electronically and received from December 15 is deliverable from Week 2 of the following year.

D.3.4. If a product is temporarily unavailable or not yet manufactured, it will be shipped to the CUSTOMER within 7 working days from its actual return to stock or its manufacture.

D.3.5. Le Petit Artiste delivery times are given for information purposes only; Any delays in delivery cannot give rise to damages, penalties, withholding and/or cancellation of orders in progress, except in cases provided for by law. With the exception of products indicated in the catalog as being subject to a specific delivery time, if an ordered product cannot be supplied within 60 days from the date of receipt of the order, the CUSTOMER would be offered by Le Petit Artiste the substitution of an equivalent product or the cancellation of their order. To prevent any supply and transport difficulties, the CUSTOMER is invited to plan their orders to take into account summer periods and end-of-year celebrations.

D.3.6. Delivery is made to a single point, located on the ground floor.

E - CLAIMS AND WARRANTY

E.1. Complaints related to delivery (damage / missing):

During delivery, it is the CUSTOMER's responsibility to check the good condition of the products. In the event of damage or shortage, it is the CUSTOMER's responsibility to enter precise and complete reservations on the transport documents, listing the damaged products. A copy will be sent for information to the Customer Service of Le Petit Artiste Zone d’Activité Du Coudoulous, Route des Taillades, 30120 AVEZE. After the driver's departure, no recourse is possible if products are damaged.

E.2. Complaints linked to an error by Le Petit Artiste:

Any complaint regarding an error on one or more products received must be made to Le Petit Artiste Customer Service, within 7 days of receipt of the products concerned. Failing this, the CUSTOMER loses all right to compensation. Any returned product must have received express prior agreement from Le Petit Artiste Customer Service. Only returns of products in new condition, in their original packaging, with all their accessories (notes, etc.) and having been the subject of a return authorization from Le Petit Artiste will be accepted.

Collected or cash on delivery shipments are not accepted.

Any return will be subject, after verification by the Technical Service, to an exchange under the conditions described below:

  • After checking the conformity of the shipment, Le Petit Artiste will send to the CUSTOMER, within 15 working days from receipt of the incorrect product(s), the product(s) initially ordered subject to availability in stock or manufacturing lead time by the factory.
  • In the event of a shortage of one or more product(s) ordered, Le Petit Artiste Customer Service will contact the CUSTOMER to offer them equivalent product(s) in terms of function or in terms of budget.
  • The CUSTOMER will then be able to:
    • Receive the agreed product(s) within 15 working days of your choice, with an additional invoice in the event of a price excess compared to the product(s) initially ordered )
    • Refuse the product(s) offered and request a refund of the purchase price. In this case, the CUSTOMER will receive a credit that can be used within 12 months. In certain special cases (impossibility of renewing an order within the stipulated period) and upon justified request, the CUSTOMER may be reimbursed by check or transfer within 30 days of his request, in this case, the costs relating to This reimbursement will be the responsibility of the CUSTOMER.

E.3. Claims related to a defective product / Warranty:

The products presented in the Le Petit Artiste catalogs (paper and electronic) are guaranteed against any material or manufacturing defect for a minimum period of 1 month from their delivery date, excluding opened consumable products. and wearing parts.

Interventions under the guarantee cannot have the effect of extending the duration of the guarantee. The warranty does not apply to apparent defects which have not been reported within the time limit provided for in article E.2 “Complaints”. Also excluded from the warranty are deteriorations caused by natural wear and tear, by lack of or poor maintenance, by an external event or by use not in accordance with the specifications of the Manufacturer and/or Le Petit Artiste. To benefit from the guarantee, the CUSTOMER must provide Le Petit Artiste customer service with any indication as to the reality of the defects reported and in particular photos of the product.

He must, within the guarantee period, send his request preferably by email: contact@lepetitartiste.com or by registered letter with acknowledgment of receipt to Le Petit Artiste Customer Service or by telephone on 04 67 22 42 97. On the instructions of Le Petit Artiste Customer Service, the CUSTOMER may be required to return the product(s) concerned for analysis of the technical service of Le Petit Artiste.

If, on the basis of the letter and/or the examination of the product by the technical service, the product turns out to be defective, the Customer Service will offer the CUSTOMER one or more of the following possibilities (at the choice of Le Petit Artiste ):

  • the free supply of a new item to replace the item recognized as defective, to restore the product to working order (the replacement of any defective part will be carried out by the CUSTOMER). After repair of the product, the CUSTOMER will, under his sole responsibility, dispose of the replaced defective part or product, in order to avoid any risk of accident or injury to children.
  • sending, free of charge, a new copy of the same product. In the event of a break, the procedure described in article E.2 applies. If it turns out that the product is not defective, it will be returned. Any postage due or cash on delivery shipment is not accepted by Le Petit Artiste.

E.4. Force majeure:

Le Petit Artiste is not responsible in the event of the occurrence of a fortuitous event or an event of force majeure, in particular in the event of fire, floods, riots, war, pandemic, interruption of the supply of energy, raw materials or spare parts, as well as total or partial strikes of any nature hindering the smooth running of society, such as transport or postal service strikes. The occurrence of such a case has the effect of suspending the execution of Le Petit Artiste's contractual obligations.

E.5. Games / Books:

These products are neither returned nor exchanged.

F – PRODUCT SAFETY PRECAUTIONS

When regulations provide for it, the products offered by Le Petit Artiste are subject to conformity tests with approved laboratories and meet current French and European standards. Le Petit Artiste products have been designed to be used in the specific context of educational activities carried out under the direction or supervision of an adult. They must be used in the educational context for which they were designed and in accordance with the instructions for use that accompany them. The commissioning of the delivered products is carried out under the sole responsibility of the CUSTOMER. It is the CUSTOMER's responsibility to read and carefully keep the instructions for use, the delivery note and the invoice.

G - WASTE ELECTRICAL, ELECTRONIC EQUIPMENT (WEEE) AND FURNITURE (Eco-participation)

For equipment covered by Decree No. 2005/829 relating to the elimination of waste from electrical and electronic equipment in accordance with Article 18 of said decree, the organization and financing of the removal and treatment WEEE waste covered by this sales contract is transferred to the professional CUSTOMER who accepts them. The professional CUSTOMER will ensure the collection, processing and recovery of the equipment in accordance with article 21 of the said decree.

The above-mentioned obligations must be transmitted by successive professional CUSTOMERS to the end user. Prices take into account the eco-contribution amounts applicable according to the regulatory system in force.

H - CNIL

In accordance with the Data Protection Act of January 6, 1978, the CUSTOMER has a right of access, rectification and deletion for all data concerning him by contacting the Customer Service of the company Le Petit Artiste .

I – WITHDRAWAL PERIOD

I.1. The CUSTOMER has a right of withdrawal of 15 clear days from validation of the order.

To exercise this right, the CUSTOMER must return the product(s):

  • in new and complete condition, with all its (their) accessories, instructions etc.
  • within 15 days from validation of the order, proof of sending of the order validation email as proof.
  • Shipments are always postage paid by the CUSTOMER
  • Collected or cash on delivery shipments are not accepted by Le Petit Artiste.

I.2. As part of the exercise of the right of withdrawal, Le Petit Artiste will reimburse the purchase price of the returned product(s) within 30 days following receipt of the items at Le Petit Artiste headquarters. In this case, the CUSTOMER will receive a credit that can be used within 12 months. In certain special cases (impossibility of renewing an order within the stipulated period) and upon reasoned request, the CUSTOMER may be reimbursed by check or transfer within 30 days of his request, in this case, the costs relating to this reimbursement will be the responsibility of the CUSTOMER.

I.3. In the event of a partial return of an order, the contribution to shipping costs being fixed for the entire initial order, it cannot be reimbursed in addition to the price of the returned product(s).
